Virginia Sales Tax Exemption Setup for Corporation

Nonprofits seeking sales tax exemption in Virginia must apply by completing the registration process through the Nonprofit Online portal.

  1. Create a Nonprofit Online Account

    Create a Virginia Tax Nonprofit Online account by clicking the 'Sign Up' button for new users.

  2. Register for Sales Tax Exemption

    Submit your exemption form to register your organization for a retail sales and use tax exemption.

Virginia Sales and Use Tax Setup for Corporation, LLC, LLP

In general, if you sell tangible personal property and certain taxable services in or for use in Virginia, you are considered a "dealer" by Virginia Tax (VATAX) and must register to collect and pay sales tax. If you are a dealer with a place of business (e.g. an office or a warehouse) in the state, you have physical nexus and should register as a "in-state dealer". If you have made at least 200 transactions or $100,000 gross sales directly to Virginia customers, you have economical nexus. If you have economical nexus but no physical nexus, you should register as an "out-of-state dealer". If your products are exclusively sold through a marketplace facilitator (e.g. Amazon or Etsy), you do not have economical nexus and are not required to register to collect sales tax in Virginia; your marketplace facilitator is responsible for sales tax. Note: SaaS sales are generally not taxable in Virginia.

  1. Register for Sales Tax Certificate

    If you are required to collect sales tax, you should use VATAX's Online Services for Businesses portal to register for a Sales Tax Certificate of Registration (ST-4). When you complete registration, you can immediately access your Sales Tax Certificate and a 15-digit sales tax account number. Note: By default the filing frequency for sales and use tax is monthly, unless you are otherwise notified.

Virginia Sales Tax Reporting for LLC, Corporation, LLP

If you are registered to collect sales tax, based on your sales tax liability Virginia Tax (VATAX) will assign you a monthly or quarterly filing frequency for sales tax returns. You must file a return even if no sales tax was collected in a reporting period. Returns are due 20 days after the end of the month or quarter. Note: VATAX reassess your filing frequency every year based on your average monthly sales tax liability. You will be notified late in the year if your filing frequency has changed for the upcoming year.

  1. File Sales and Use Tax Return

    Log in to VATAX's Online Services for Businesses portal and fill in the sales tax return form (Forms ST-8 or ST-9) displayed in you account.
