Utah Sales Tax Exemption Setup for Corporation

501(c)(3) nonprofits may apply for exemption from sales tax with the Utah State Tax Commission by filing the Application for Sales Tax Exemption Number for Religious or Charitable Institutions (Form TC-160).

  1. Complete Application for Sales Tax Exemption Form

    Download and complete the Application for Sales Tax Exemption Number for Religious or Charitable Institutions (Form TC-160).

  2. Submit Form to the State Tax Commission

    Mail the completed form and attach a copy of the determination letter from the IRS qualifying your organization as exempt to the Utah State Tax Commission.

Utah Sales Tax Setup for Corporation, LLP, LLC

If you sell tangible personal property, products transferred electronically, or services for storage, use, or consumption in Utah, you are required to register with the Utah State Tax Commission to collect and pay sales tax. If you are an out-of-state entity at least 200 transactions or $100,000 in Utah sales for the current or previous calendar year, you have nexus for the purpose of sales tax. Note: Utah has ruled that license fees for remotely accessed software (i.e. SaaS) are taxable if the software is prewritten, not taxable if the software is custom.

  1. Estimate Sales Tax Liability

    Estimate your sales tax liability for the year. The Utah State Tax Commission will use your estimate to assign a filing frequency for your sales tax account.

  2. Register for a Sales Tax Account Online

    Log in to your Utah Taxpayer Access Point (TAP) account to register for a sales tax account. If this is your first tax registration with Utah, select "Apply for tax account(s) - TC-69" from the TAP homepage.

Utah Sales Tax Return for Corporation, LLC, LLP

Businesses with sales tax account in Utah must file sales tax returns. Your filing frequency depends on your sales liability of the previous calendar year: if you owed $1,000 or less, you are an annual filer. If you owed $1,001 to $50,000, you are a quarterly filer. Businesses with larger tax liability are monthly filers and may be subjected to additional payment and filing requirements. Note: The filing frequency of a new businesses is assigned during sales tax registration based on their estimated annual liability.
